Samuel Ndung’u Karanja operates NDUNGU in Nairobi, Kenya. These terms explain use of the website and how a commission or plan licence is agreed. The written appointment or licence sets the terms for your particular project, subject to any mandatory rights that apply.
You can browse projects, email a project brief and download available service sheets for reference. The website offers enquiries and free reference downloads. Online checkout and paid plan downloads are currently unavailable.
Enquiries and design appointments
Our office secretary receives initial enquiry calls and emails. Sending a brief lets us assess the work and respond. We begin commissioned work after both parties accept a written appointment and any agreed starting conditions are met.
Before appointment, we confirm the parties, project and site, scope, deliverables, file formats, revisions, exclusions, fees and payment stages, target dates and any separately appointed professionals. We provide a copy of the agreed terms for your records. Please identify the project stage, information available and any deadlines or decisions that affect the work.
The Kenya Home Starter Study gives you an initial layout and findings for your site, with one review and one minor revision. If you commission the full bungalow package for the same unchanged project, the KES 15,000 fee is credited once and the included revision counts toward the full package’s revision allowance. We record the credit and any scope changes in the written agreement.
Fees, changes and delivery
Website prices describe the stated reference scopes in Kenyan shillings. Your written offer confirms the total payable, any applicable taxes and charges, what is included, and which third-party costs you would pay separately. For a standard scoped bungalow design commission, the published stages are 40% on appointment, 30% on agreed design approval and 30% before final release. The Starter Study has its own full-payment-on-appointment terms, subject to applicable cancellation rights.
We agree changes to the brief, extra revisions, additional files and any effect on fees or delivery before starting the additional work. Delivery targets run from the agreed start and depend on receiving the required inputs and decisions. We will discuss revised dates if the brief changes, inputs are delayed or third-party work affects the programme.
Cancellation, refunds and concerns
You can cancel an enquiry by contacting us. If you have accepted an appointment, check the cancellation terms supplied with it and email us with the appointment reference, what you wish to cancel and the date. Your rights and any refund depend on the applicable law, the type of contract, when you cancel and, where relevant, whether work started at your express request.
Where a statutory cancellation period applies, we will explain it before you agree. If you want work to start within that period, we will explain the effect and record any request or consent the law requires. Any charge for work already carried out or deduction from a refund will follow the agreed terms and applicable law. Paying a deposit does not remove mandatory cancellation or refund rights.
If work or a file is missing, faulty or differs from what was agreed, contact us with the reference and details. We will review the issue and explain the available remedy. These terms preserve any mandatory consumer protections, remedies and rights to use a competent dispute resolution body or court.
Drawings and professional responsibilities
Use the current issued revision for its stated purpose. Concept drawings, visualisations, site studies and portfolio sheets are for discussion and review. Before construction, the appropriate appointed professionals must verify site conditions, coordinate technical design and obtain any required approvals. Structural engineering, statutory submissions, certification and other regulated responsibilities are agreed separately with the appropriate professionals.
Tell us about known site constraints and provide information you are entitled to share. The written appointment sets out who checks surveys, dimensions, technical inputs and subsequent revisions. If you commission design work, the appointment also sets out what you and your project team may do with the deliverables, including any rights to adapt them and whether editable files are included.
Portfolio material and free downloads
Copyright and other rights in website text, drawings, images and logos belong to NDUNGU or the relevant rights holders. You may browse the site and save a free service sheet for personal reference or private discussion with your project team. Keep the credits and status labels attached. Sharing a link to the project page is welcome.
Use beyond that permission, such as republishing the drawings, selling copies or adapting a portfolio design for construction, requires permission from the relevant rights holder unless the law permits that use. A service sheet illustrates a design and its scope. Construction use requires a separate appointment or appropriate licence and site-specific technical work.
Future paid plan licences
Paid plan licences are a future offer. When a package is available, the written offer will explain what it contains, what the buyer and appointed professionals may do with it, the total price, delivery arrangements and applicable cancellation rights. The default licence will cover one named site and one build. Documented adaptations by the appointed project professionals will be subject to that licence.
